Certification of gravel, scoria, topsoil or sand surface mining operations
County weed boards may inspect gravel, scoria, topsoil, or sand surface mining operations to certify that they are not contaminated with noxious weeds, if requested.
Standards:
*For these standards, “material” refers to gravel, scoria, topsoil, or sand
- Inspection must be by a weed control officer;
- Material must be inspected in the area of origin, prior to movement;
- Operations should maintain a weed management plan to prevent dissemination of seed or other propagative parts, and must provide to weed control officer upon request;
- Compliance with local ordinances;
- County certification document must include the following statement “Surface mining operation is compliant with N.D.C.C. 4.1-47 on the date inspected. This certification provides no guarantee of freedom of weed seeds.”
