The North Dakota Department of Agriculture can approve the use of pesticides for localized pest problems or emergency pest situations outside of the full registration process. Section 24(c) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) permits the Department to approve Special Local Need (SLN) registrations to address pest problems that may be unique to North Dakota. Section 18 of FIFRA permits the Department to apply to the U.S. Environmental Protection Agency for an emergency exemption to allow short-term use of a pesticide to address an emergency pest situation.
For more information on Section 24(c) registrations and Section 18 exemptions, please refer to the document "North Dakota Department of Agriculture Pesticide Registration and Exemption Guidelines".
A listing of the currently active Section 24(c) and Section 18 registrations can be found on the North Dakota pesticide registration database at: http://www.kellysolutions.com/ND/pesticideindex.asp.
